Legal agreement for using the ErsatzTV IPTV streaming server service
These Terms of Service (ToS) apply to all agreements between ErsatzTV (hereinafter "Provider," "we," or "us") and customers (hereinafter "Customer," "you") regarding the use of our IPTV streaming server service. Any deviating terms of the Customer will not be recognized unless we expressly agree in writing to their applicability.
ErsatzTV is a premium IPTV streaming server provider. Our service includes access to live television channels, video-on-demand (VOD) content, and other digital services via an internet connection. We offer ErsatzTV with 20,000+ channels and 60,000+ VOD titles in 4K/8K quality. Unlike setting up your own ersatztv plex server, we provide a fully managed live tv server experience.
The presentation of our ErsatzTV plans on our website does not constitute a legally binding offer, but an invitation to the Customer to submit an offer. By ordering a subscription via WhatsApp or email, the Customer makes a binding offer to enter into an agreement for our iptv stream server. The agreement is concluded when we expressly accept the offer, which occurs by sending the login credentials via WhatsApp or email.
The contract text is not stored by us and is therefore not accessible to the Customer. However, the Customer can view their order details via the order confirmation via WhatsApp and email.
Our ErsatzTV subscriptions include access to a large number of live television channels, video-on-demand content, and other digital services through our streaming server. The prices listed on our website at the time of ordering apply. All prices are in US Dollars ($) including applicable taxes, unless otherwise stated. Prices apply to the selected subscription period (3, 6, 12, or 24 months). The subscription does not automatically renew after the agreed term. The service ends automatically after the booked term.
Payment of the agreed price is due after the conclusion of the agreement for your ErsatzTV subscription. The Customer can choose from the following payment methods: credit card (Visa, Mastercard, American Express), PayPal, or cryptocurrency (Bitcoin). Payment processing takes place via certified third parties. We do not store the Customer's credit card or bank details.
The IPTV streaming server service is activated after receipt of payment. In the event of late payment, we reserve the right to refuse the service or terminate the agreement. The Customer is responsible for reporting a failed payment.
After successful payment for your ErsatzTV subscription, the Customer will receive their login credentials (Xtream Codes: Server URL, Username, Password) within 5 minutes via WhatsApp or email. The Customer is obliged to treat the login credentials confidentially and protect them from access by third parties. In the event of loss or misuse of the login credentials, the Customer is obliged to notify us immediately. In that case, we will provide new login credentials for your streaming server.
Each subscription is intended for a specific number of devices (1-5). Simultaneous use on more than the booked number of devices is not permitted and may lead to blocking of access to your live tv server.
The Customer is entitled to use the ErsatzTV IPTV service exclusively for private, non-commercial purposes. Commercial use, in particular the public display of the service in business premises, hotels, restaurants, or similar establishments, is prohibited without our express written consent.
The Customer is not authorized to pass on the login credentials to third parties or to make the service available to third parties. Distributing, recording, or making public content from the service is prohibited. In the event of violation of these usage conditions, we reserve the right to block access to the iptv stream server without prior notice and to terminate the agreement extraordinarily. In this case, no refund of already paid amounts will be made.
We strive for the highest possible availability of our ErsatzTV service at 99.9% of the time. However, technical failures, maintenance work, force majeure, and problems with the Customer's internet connection may lead to temporary restrictions on your live tv server. Scheduled maintenance will be announced in advance via WhatsApp or on the website if possible.
We are fully liable for damages resulting from death, personal injury, or health damage caused by an unintentional or intentional breach of duty, as well as for damages resulting from a breach of essential contractual obligations. In the event of a breach of essential contractual obligations, liability is limited to the typical, foreseeable damage, unless there is intent or gross negligence. Liability for data loss is limited to the typical recovery costs for your iptv stream server usage. Liability for indirect damage or loss of profit is excluded.
The agreement for ErsatzTV runs for the minimum term chosen by the Customer (3, 6, 12, or 24 months) and ends automatically after this term. There is no automatic renewal. After the minimum term, the Customer can extend the subscription by placing a new order for our streaming server.
The right to extraordinary termination for good cause remains unaffected. Good cause exists in particular if the Customer violates the usage conditions, passes on the login credentials to third parties, or misuses the live tv server service.
Consumers have a statutory right of withdrawal as set out in applicable consumer protection laws. Since ErsatzTV subscriptions are digital services that are provided immediately after the conclusion of the agreement, the right of withdrawal expires once the service has been fully performed, provided that the Customer has expressly consented to the commencement of performance before the end of the withdrawal period. ErsatzTV obtains this express consent before concluding the agreement.
As a service, we offer a voluntary 7-day money-back guarantee for your iptv stream server subscription, provided that the use of the service does not exceed 5 hours and the trial period has not been misused. More information can be found in our Right of Withdrawal policy.
The protection of your personal data is important to us when you use ErsatzTV. Information about the collection, processing, and use of your data can be found in our Privacy Policy. We process personal data in accordance with the General Data Protection Regulation (GDPR), the California Consumer Privacy Act (CCPA), and applicable international privacy laws for your live tv server account.
The Customer agrees not to use the ErsatzTV service for unlawful purposes or to transmit content that:

ErsatzTV operates on a fair use policy. The streaming server is intended for normal residential use. Excessive or abusive use that negatively affects other customers may result in service restrictions. Examples of excessive use include:
We reserve the right to change these Terms of Service for ErsatzTV at any time. Changes will be communicated to the Customer at least 30 days before they become effective via email or WhatsApp. If the Customer does not agree to the changed terms, they have the right to terminate the agreement effective as of the date the changes become effective. The right to terminate the agreement without notice remains unaffected. Changes that are legally required or that are solely for the benefit of the Customer will become effective immediately.
All legal relations between ErsatzTV and the Customer are exclusively subject to the laws of the State of Illinois and applicable federal laws of the United States of America, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). The application of other legal systems is excluded.
The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr/. We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board. Disputes shall be submitted to the competent court of our jurisdiction.
If one or more provisions of these Terms of Service for ErsatzTV are invalid or become invalid, the validity of the remaining provisions shall remain unaffected. In place of the invalid provision, the statutory provision that most closely corresponds to the economic purpose of the invalid provision shall apply.
The English version of these Terms of Service is the only authentic version. In the event of translations into other languages, the English version is binding.
